General conditions of the online game "PROMO GAME"

1. ORGANIZER AND RULES OF THE GAME.

The organizer of the online game "PROMO GAME" ("the Game") is MODUL EOOD, Mt. Chanlaka, PI #00182.45.47, Aksakovo 9154, Bulgaria, EIK: 103846775, also called "The Organizer" or "Top Rent A Car".

2. PROMOTION TERRITORY.

The game is organized and held on the territory of Bulgaria in the period from 09:00 on 01.01.2023 to 09:00 on 31.12.2023 on the Instagram profile of Top Rent A Car (https://www.instagram.com/toprentacar.bulgaria/). Any participation described in the game mechanism in point 4 after this period will not be considered valid.

3. REWARDS.

By participating in the Game, the Participant can win:

1. Reward for existing customers - a refund of the value of the last used Top Rent A Car rental service of up to 7 rental days. If it is for a longer period, only the first 7 days become free. The prize covers only the rental price of the car, without extras, fines, fees, etc.
2. Reward for non-Top Rent A Car customers - provision of a voucher to use a Top Rent A Car rental service for up to 7 rental days. The voucher can be used for classes: economy, compact and electric. The voucher only covers the rental value of the car, without any additional extras, fines, fees, etc. When using the voucher for a shorter period than 7 rental days, the difference in value is not refunded. 4. GAME MECHANISM.

In order to be able to win the prize specified in point 3, the Participant must::

1. To correctly fill out the registration form on the promo page at the link: https://toprentacar.bg/en/win
2. Each participant must have a public Instagram account.
3. Take a picture of yourself posing with a Top Rent A Car car and upload it to your Instagram profile
4. To mention/tag the Instagram profile of Top Rent A Car (@toprentacar.bulgaria) in the text/photo of your post.
5. Photos must match the theme of the game - posing with a Top Rent A Car
6. The number of photos with which a participant can enter the game is unlimited.
7. The winning photo will be drawn through a random drawing involving all eligible entrants.
8. Entry into this contest is public and the entrant hereby agrees that his/her Instagram profile name or personal names will be visible to all in posts announcing the winners.
9. For the photo to be entered into the draw, the entrant must continue to follow the Top Rent A Car Instagram profile (https://www.instagram.com/toprentacar.bulgaria/) and save their post with the photo on their Instagram profile and to have tagged the Instagram profile of Top Rent A Car until 31.12.2023 inclusive.
10. Top Rent A Car will select an additional 2 photos in each monthly drawing as backups in case any of those already selected delete their post, untag the Top Rent A Car Instagram account from their post, unfollow Top Rent A Car Instagram account Car or does not meet one or more of the conditions for participation described in section 4 of this document.

5. RULES FOR RECEIVING PRIZES.

1. The Organizer must contact the winners via an email message to the email provided by each winner at the time of completing the registration form. The Organizer shall obtain from each winner the following required personal information (Confirmation of GDPR agreement for the collection of personal data; Instagram ID; Email address in order to claim their prize.)
2. Each winner must respond to the email received within 72 hours of receipt. If any of the winners does not respond within this period, they lose their right to the prize and the organizer will contact the second reserve entrant.
3. To be announced as a winner and receive their prize, each winner must continue to follow the Top Rent A Car Instagram profile (https://www.instagram.com/toprentacar.bulgaria/) and save their post with the photo of their Instagram profile and has tagged Top Rent A Car's Instagram profile until 31.12.2023 inclusive.
4. Prizes cannot be exchanged.
5. Prizes will be transferred to the winners (reserves) within 10 working days of the dates below via bank transfer. If the winner is not a Top Rent A Car customer, they will receive a voucher for a rent-a-car service for up to 7 rental days. The voucher can be used for classes: economy, compact and electric. The voucher only covers the rental value of the car, without any additional extras, fines, fees, etc. If the voucher is used for a shorter period than 7 rental days, the difference in value is not refunded.
6. Each winner has the right to claim his prize only if he has provided the necessary personal information to the organizer (Confirmation of GDPR agreement for the collection of personal data; Instagram ID; Email address;)

6. ANNOUNCEMENT OF WINNERS:

1. The monthly winners will be announced on the Instagram profile of Top Rent A Car (https://www.instagram.com/toprentacar.bulgaria/) every first Monday of the month, respectively:
   • The winner for January 2023 - will be announced on 02.06.2023 (4:00 p.m.)
   • The winner for February 2023 - will be announced on 03.06.2023 (4:00 p.m.)
   • The winner for March 2023 - will be announced on 03.04.2023 (4:00 p.m.)
   • The winner for April 2023 - will be announced on 01.05.2023 (4:00 p.m.)
   • The winner for May 2023 - will be announced on 06.05.2023 (4:00 p.m.)
   • The winner for June 2023 - will be announced on 07.03.2023 (4:00 p.m.)
   • The winner for July 2023 - will be announced on 07.08.2023 (4:00 p.m.)
   • The winner for August 2023 - will be announced on 04.09.2023 (4:00 p.m.)
   • The winner for September 2023 - will be announced on 02.10.2023 (4:00 p.m.)
   • The winner for October 2023 - will be announced on 06.11.2023 (4:00 p.m.)
   • The winner for November 2023 - will be announced on 04.12.2023 (4:00 p.m.)
   • The winner for December 2023 - will be announced on 03.01.2024 (4:00 p.m.)
2. The Organizer reserves the right not to draw a winning participant if there are less than 15 participants in the game for the relevant calendar month. In such a case, a prize is drawn the following month.
3. In the event of technical difficulties at www.instagram.com, due to circumstances beyond the control of the Organizer, the announcement of the winner will be made after a solution to the difficulties encountered has been found and implemented.

7. ADDITIONAL INFORMATION.

1. The organizer reserves the right to disqualify a participant at its own discretion if non-compliance with these general conditions is found; in case of established game manipulation by creating fake profiles in order to participate in the game; in the case of a game-related or non-game-related post that contains inappropriate (pornographic or violent content, showing nude bodies or naked body parts, sexual/obscene scenes or gestures; homophobic, racist or discriminatory content, images, symbols and gestures) content or content contrary to the laws and regulations of the country.
2. The game is organized and held only on the territory of the Republic of Bulgaria.
3. Employees of the organizer or their relatives may not participate in the Game.
4. The organizer reserves the right to change the General Terms and Conditions at any time by announcing this on the official Instagram account of Top Rent A Car: https://www.instagram.com/toprentacar.bulgaria/
5. The Organizer has the right to terminate the Game at any time, in case of abuse by the Participants of the Promotion, violation of the General Terms and Conditions of the Game and/or force majeure circumstances.
6. Termination of the game before its deadline, according to point 7.5., will be announced on the Instagram profile of Top Rent A Car: https://www.instagram.com/toprentacar.bulgaria/
7. The Organizer is not responsible for any kind of lost information related to the Game on Instagram.
8. The organization, presentation, conduct and regulation of the Game are in no way controlled or managed by Meta Platforms Inc.
9. By participating in the Game, all entrants agree that their Instagram profile name, their comments and public Instagram profiles may be used to create awareness of the Game.
10. By participating in the Game, all participants declare that they have read and agree to the General Terms and Conditions and any other changes that may be made later.
11. By participating in the game, each participant declares that the person in the photo uploaded by him participating in the game is himself. The participant agrees to Top Rent A Car using the uploaded photo in the company's marketing activities.
12. The participant agrees that Top Rent A Car will use the provided photos in the company's marketing activities such as advertising videos, digital pages, social networks, newsletters, printed materials and other similar marketing activities, for an unlimited period!

8. PERSONAL DATA.

1. The personal data of all Participants in the Game are processed in accordance with the current legislation and the Privacy Policy of Top Rent A Car, available at: https://toprentacar.bg/en/privacy-policy
2. The Organizer is the administrator of personal data collected in connection with the Promotion. The data that identify the Organizer in its capacity as an administrator and the contact details for it are specified in point 1 above.
3. In connection with the participation in the Game, the Organizer processes the following data that the Participants provide during their participation in the Game.
   • Instagram profile name
   • Instagram profile picture
   • User's Instagram ID
   • The photo uploaded by the user
   • E-mail address
4. In connection with sending the prize, the Organizer processes the following data, which the Participant provides after a possible victory in the vote:
   • Confirmation of GDPR data collection agreement
   • Instagram profile name
   • Instagram profile picture
   • User's Instagram ID;
   • E-mail address
5. The provision of the above data is a necessary requirement for participation in the Promotion, otherwise participation will not be possible.
6. The Organizer will process the above-mentioned personal information of the Participants solely for the purpose of administering the Game, namely to organize and establish the fulfillment of the terms of the Game and to provide the prize therein.
7. The legal basis for processing personal data is the need to perform a contract to which a Participant is a party, or to take steps at the request of the data subject before entering into a contract (these are the present General Terms and Conditions, which define our contractual relationship with the Participants). The Organizer may process personal data of Participants also on the basis of its legal obligation, when applicable.
8. The data will be stored for a period of up to three months after the award of the prizes, except in cases of a legal requirement for a longer storage period (for example, tax and accounting requirements). The personal data collected from the winning Participants will be used for a period of no longer than 3 months after their receipt.
9. User uploaded photos will be stored for up to 24 months from the date of upload.
10. Participants have the following rights in relation to the processing of their personal data in connection with the Promotion:
    • (a) to ask Top Rent A Car whether their personal data is being processed and to receive a copy of it, as well as the information related to the processing;
    • (b) request the correction of inaccurate personal data relating to them, as well as the right to have incomplete personal data completed;
    • (d) receive the personal data concerning them and which they have provided to Top Rent A Car, in a structured, widely used and machine-readable format; if they request and it is technically feasible, Top Rent A Car may transfer this data to another administrator indicated by the Participant;
    • (e) request the deletion of personal data relating to them when the personal data are no longer necessary for the purposes for which they were collected or otherwise processed; when they have been processed unlawfully; or when they need to be deleted in order to comply with a legal obligation of Top Rent A Car;
    • (f) to request restriction of processing when disputing the accuracy of personal data, for a period that allows Top Rent A Car to verify the accuracy of the data; when the processing is unlawful, but the Participant does not want the personal data to be deleted, but instead requires the restriction of its use; and when Top Rent A Car no longer needs the personal data for the purposes of processing, but the Participant requires them for the establishment, exercise or defense of legal claims;
    • (е) file a complaint with a supervisory authority if they consider that the processing of their personal data violates applicable law. The competent supervisory authority for Bulgaria is the Commission for Personal Data Protection;
11. Participants can exercise their rights under letters (a) - (e) above by submitting an application to exercise the corresponding right in whichever of the following ways is more convenient for them:
    • (a) electronically at the following address: https://toprentacar.bg/en/contacts; or
    • (b) by mail to the Company's correspondence address: Varna, "Chaika" quarter, 16B, Varna 9000, Bulgaria.
12. Your application must contain the following information:
    • (a) information that allows Top Rent A Car to identify the Participant;
    • (b) preferred method of communication with the Participant;
    • (c) a description of the request;
13. Top Rent A Car will provide information on the action taken on a submitted application within one month of receiving it. If necessary, this period can be extended by another two months, taking into account the complexity and number of requests of the relevant Participant.
14. Top Rent A Car may request the provision of additional information necessary to confirm the Participant's identity or further specify his application.
15. The personal data of the Participants may be provided by the Organizer to subcontractors and service providers engaged by the Organizer in connection with the organization of the Promotion; to accountants, tax consultants or experts, if necessary to fulfill the Organizer's obligations; of authorities in compliance with the statutory order; to lawyers or legal advisers in the event of disputes or other legal proceedings.
